A key component to successfully litigating an automobile collision case is identifying all available insurance coverage that would apply to a case. Under Florida law, the owner of a vehicle is responsible for any injuries caused by the use of that vehicle. Similarly, an employer is legally responsible for the damages caused by one of its employees while on the roadways.
As part of our investigation of all parties involved, we will identify and locate assets, run an employment, civil, and criminal litigation history, and request a driving record report. We will also obtain cell phone records to determine whether the other driver was on a call or, worse, sending or receiving a text message at the time of the crash.
For cases that involve buses or trucks, federal and state laws place numerous requirements not simply on the driver, but also the owner, operator, shipping company, and transporter. Commercial drivers are required to undergo training and pass a written and a driving examination in order to obtain a Commercial Driver's License. Other laws enforced by the Federal Department of Transportation Department of Motor Carrier Compliance are ones that regulate driver hours, attempt to prevent driver fatigue, increase the visibility of red reflective tape on the rear of cargo trailers, increase the frequency and quality of maintenance, and that ensure a safe depth for truck tire tread.
